Legal Authority to Collect PII

  • Section 1312(e) of the Affordable Care Act (ACA) authorizes the Secretary of the U.S. Department of Health and Human Services to establish procedures for Agents and Brokers to participate in an Exchange.
  • 45 CFR 155.220 permits Agents and Brokers to assist with Qualified Health Plan (QHP) enrollment through an Exchange and with applications for Advance Premium Tax Credits (APTCs) and/or Cost-Sharing Reductions (CSRs).
  • 45 CFR 155.220(d) requires Agents and Brokers to comply with the terms of an agreement with the Exchange when enrolling Qualified Individuals or assisting with APTCs and CSRs. (Insert footnote here with the full name of the agreement and web address for reference.)

Purpose of Collecting PII

With your consent, Eaton Agency may gather PII from you and/or your family in order to:

  • Determine eligibility for insurance products
  • Assess suitability of insurance products
  • Provide insurance quotes

To Whom PII May Be Disclosed

Your PII may be shared with:

  • The U.S. Federal Government through Healthcare.gov
  • Department of Health and Human Services
  • Arkansas Insurance Department
  • Arkansas Department of Human Services
  • Arkansas Health Insurance Marketplace
  • Insurance companies (through web-based quote engines and broker support personnel)
  • Insurance marketing organizations (through web-based quote engines and support personnel)

The purpose of these disclosures is to quote, determine suitability, and establish eligibility for insurance products.

Authorized Uses and Disclosures

A. Individual Health Insurance

Agents and brokers may use PII to:

  1. Assist with QHP applications and eligibility
  2. Support QHP selection and enrollment
  3. Assist with APTC/CSR applications and selections
  4. Collect required attestations
  5. Assist with exemptions and appeals
  6. Transmit QHP enrollment and subsidy information
  7. Facilitate premium payments and disenrollment
  8. Educate consumers about insurance affordability programs (including Medicaid/CHIP)
  9. Assist with reporting eligibility changes
  10. Correct errors in applications
  11. Remind enrollees about renewals and eligibility changes
  12. Provide education on health plan options and usage
  13. Resolve complaints or assess satisfaction
  14. Communicate with QHP issuers and regulators
  15. Carry out other CMS-approved functions

B. Small Group Health Insurance (FF-SHOP)

Agents and brokers may use PII to:

  1. Assist employers with applications and eligibility
  2. Support FF-SHOP QHP selection and enrollment
  3. Facilitate premium contribution and payment
  4. Manage employee and dependent enrollment/disenrollment
  5. Handle coverage changes (e.g., hires, separations, dependents)
  6. Assist with appeals
  7. Provide customer service, complaint handling, and error corrections
  8. Communicate with QHP issuers, regulators, and CMS
  9. Conduct quality assurance and consumer satisfaction assessments
  10. Provide educational materials on health coverage
  11. Carry out other CMS-approved functions

Is Disclosure of PII Voluntary or Mandatory?

Disclosure of PII is voluntary. You are under no legal obligation to provide PII.

Effects of Not Providing PII

If you choose not to disclose PII, Eaton Agency may be unable to:

  • Determine your eligibility for insurance products
  • Assess suitability of insurance products
  • Provide insurance quotes

Your Rights

  • Access: You have the right to know what PII we have collected, maintained, or stored about you and/or your family. Upon written request, Eaton Agency will provide this information within thirty (30) days.
  • Amendment/Correction: You have the right to request amendment, correction, substitution, or deletion of your PII if you believe it is inaccurate, incomplete, or not necessary. Requests must be addressed within ten (10) working days.
